Agreement to Terms

By accessing or using Healway.pro ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all users of the Platform, including healthcare providers, clinic staff, and patients.

1. Service Description

Healway.pro is an AI-assisted healthcare practice management platform that provides:

  • Patient intake and symptom collection
  • Consultation management and audio transcription
  • AI-assisted clinical note generation
  • Prescription management
  • Follow-up scheduling and reminders

The Platform is designed to assist healthcare providers in their practice and does not replace professional medical judgment.

2. User Responsibilities

For Healthcare Providers:

  • You must be a registered medical practitioner (RMP) with valid MCI/NMC registration
  • You are responsible for verifying patient identity and obtaining appropriate consent
  • You must review and approve all AI-generated content before use in clinical practice
  • You are responsible for maintaining the confidentiality of your account credentials

For All Users:

  • Provide accurate and complete information
  • Use the Platform only for its intended purpose
  • Not share account credentials with others
  • Report any security concerns or unauthorized access immediately
3. Doctor Accountability

The treating physician maintains full responsibility for all clinical decisions. Specifically:

  • All diagnoses, prescriptions, and treatment plans are the sole responsibility of the treating physician
  • AI-generated suggestions and summaries are for reference only and do not constitute medical advice
  • The physician must verify all information before making clinical decisions
  • The Platform does not replace the physician-patient relationship
4. AI Usage Disclaimer & Liability Boundaries

Our Platform uses artificial intelligence to assist with:

  • Speech-to-text transcription
  • Clinical note summarization
  • Follow-up scheduling suggestions
  • Risk level assessment
  • Healix AI medical assistant

AI-Generated Content Disclaimer: All AI-generated content on Healway.pro is provided for clinical decision support purposes only. It may contain errors or inaccuracies. Healthcare providers must:

  • Review all AI-generated content before use in clinical practice
  • Exercise independent clinical judgment on every patient interaction
  • Not rely solely on AI recommendations for diagnosis or treatment
  • Confirm all clinical information before prescribing or advising

SaMD Disclaimer: Healway.pro AI tools (including clinical note generation, risk assessment, and the Healix AI assistant) are not registered as Software as a Medical Device (SaMD) under CDSCO / Drugs & Cosmetics Act, 1940. These tools are intended solely as administrative and decision-support aids for registered medical practitioners and do not constitute regulated medical devices.

We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

5. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law:

  • Healway.pro is not liable for any medical decisions made using the Platform
  • We are not responsible for any direct, indirect, incidental, or consequential damages arising from the use of our services
  • We do not guarantee uninterrupted or error-free service
  • Users assume full responsibility for their use of the Platform
  • AI Content: Healway.pro expressly disclaims all liability for any clinical outcomes, patient harm, misdiagnosis, or adverse events arising directly or indirectly from reliance on AI-generated content without independent physician verification.

Indemnification

You agree to indemnify, defend, and hold harmless Healway.pro, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Platform in violation of these Terms
  • Any clinical decisions made on the basis of AI-generated content without independent physician review and confirmation
  • Your violation of any applicable law, regulation, or third-party rights
  • Inaccurate or incomplete information provided by you or your clinic
6. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

By using the Platform, you consent to the collection and processing of data as described in our Privacy Policy.

7. Telemedicine Compliance

Use of this Platform for telemedicine consultations must comply with the Telemedicine Practice Guidelines issued by the Ministry of Health and Family Welfare, Government of India (2020).

Key compliance requirements include:

  • Only registered medical practitioners may provide medical advice
  • Proper patient identification and consent must be obtained
  • Consultation records must be maintained
  • Emergency cases must be referred to appropriate facilities
8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.

9. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform after changes constitutes acceptance of the modified terms.

We will notify users of significant changes via email or through the Platform.
